The modern democracy and the rule of law society with social structure andideology of development and change, the emergence of many social contradictionsbetween a large part of it is because of the social system appear unjust laws or policy,and part of the citizens are not treated the trigger. In western society appeared the takea rational non-violent civil disobedience the means to expect fixed unjust laws orpolicy theory, and someone put into practice.The theoretical origin of civildisobedience can be traced back to ancient Greek philosopher at least about the ideaof city politics, is rooted in the western society theory of the important issues.However, due to its itself has the particularity and in the social politics, and form theperformance for the illegal activities, and easy to misunderstand, make China to theresearch of civil disobedience relative to other theory is less. This paper hope to civildisobedience the whole through introduction of basis, through its justification search,find that the theory of civil disobedience behind value for our democracy and the ruleof law construction work.This paper mainly divided into three parts, which in turn for:The first part is about civil disobedience the whole paper, according to thegeneral understanding of matters logic, by its definition and characteristics of startanalysis. And then, based on the concept of the similar may distinguish meaningdeepening the understanding. Finally, this paper discusses such a phenomenon existsin what kind of social environment, needs how theory premise.The second part is in the preliminary civil disobedience the comprehensiveunderstanding of the basis of the special social phenomenon discussed the legitimacy.First put forward the citizens don’t obey the legitimacy, and then through the socialcontract theory, utilitarianism and Kant and other western main social and politicalphilosophy theory as the basis of a detailed analysis. The third part to return to civil disobedience, as a research object, its itself to themodern democracy and the rule of law social enlightenment, and through which weshould reflect on democracy and the rule of law society could the weakness andlimitations, and social transformation in China under the background of rationallycivil disobedience the research.
