The Analysis Of The Serious Traffic Accident Case Caused By Lanzhou Taxi Passenger

With the continuous development of the reform and opening-up the economy and society of China has changed a lot. Especially since the1990s, more and more motors come into our social life, and the traffic accidents mount up rapidly. At the same time, the subjects of the traffic accident crime present great complexity. As the subjects of the traffic accident crime are not explicitly stipulated in our current criminal law, theories vary a lot. This article makes a research on the subjects of the traffic accident crime, and puts forward analysis and opinions, hoping to solve the uncertainty of the subjects of this crime in our current criminal law.The taxi passenger Zhao Jisheng passengers cause traffic accidents case as an example in this paper, the author analysis the subject of traffic accident crime, dissect all of the parties ’responsibility in the traffic accident at the same time. The results of the analysis to the case reveal that the laws and regulations in our country about the traffic accident crime exist some defects and insufficiency also. Summing up the inspiration and experience in the case bringing us, I puts forward some suggestions on this basis.
