With the development of industrialization and economy, product liability has then become an important legal issue. Western developed countries have established product liability law to enhance the protection of consumers and balance the benefits of the three parties. The product liability system is the adjustment of product manufacturers and sellers of its products with defects, resulting in consumers’ personal or property damage to the victim should bear the civil liability of the legal system. In China, the law of product liability has turned into the urgent demand of the social economy development. However, through the research, it is apparent that there are still many shortcomings in the product liability law system. Genuine efforts on perfecting this system should be taken to meet the demands for quality and safety, and even the exuberant development of the economy.Chapter1base on the situation of the case.we find out a series of controversy in the Litigation and Practice of product liability.The Chapter2analysis the legal issues reflected in the dispute. We discussed the legal characteristics of the product liability and analysis the constituent elements of the product liability, especially the product defects. Compare the Western countries with Chinese product liability legislation, we reveals the problems in China’s legislation.The Chapter3focuses on the principles of Product Liability. At first we analysis the principles of the theory and practice of Chinese Product Liability.Secondly we discuss how the courts correctly use the principle of Product Liability to solve problems about product liability, litigants and burden of proof.Chapter4presents some recommendations of the product liability system, include the defective product, the liability doctrine,the burden of proof, and the attribution principles.
