Research On The Reproductive Rights Of The Condemned

With the deepen of democracy and the people’s awareness of the law improve gradually, the consciousness of the protection of citizens’rights is becoming more strongly. Condemned, as a special class of citizens, their basic human rights also should be protected. In practice, however, the basic human rights of the condemned are often difficult to guarantee. Through analyzing the case of "Zheng Xueli asks for reproductive rights", the article investigates the basic human rights protection of the condemned from the perspective of protecting the reproductive rights of them.The paper describes the three different views of this issue on whether the condemned should be entitled the reproductive rights. The author supports the first view that the condemned should enjoy the reproductive rights, and demonstrates his views from the legal and judicial practice. Then, the author gives a minute introduction on the subject and implementation of the reproductive rights of the condemned. Finally, for the case, the author raises the legal obstacles of the reproductive rights and proposes the legislative conception for these legal obstacles.The case of Luo Feng brings new challenges to China’s judicial system, people should actively respond to the new challenges, because justice is the last barrier of reliving the human rights. People believe, the case of Luo Feng is not a moment of impact on the judicial, which will have landmark significance on the protection of the rights of the condemned. Through investigating the case, the author wishes to seek more ways to protecting the reproductive rights of the condemned, and then improve the legislation of our country on guaranteeing the rights of the condemned.
