It seems absurd to discuss human rights in a country that lacks a strong awareness of the protection of such rights. For many people, it appears making trouble out of nothing to appeal for the endowment of more rights with the criminals sentenced to death. However, I am not in line with such viewpoint. Even vegetation show sympathy to others, not to speak of human beings. The fact that the number of death penalty sentenced and applied in China stands first on the list every year warrants our attention on the those numerous condemned criminals, whose basic rights and interests should be efficiently protected, based on a simple preconditon that we all have the same name--human being.In consideration of the above analysis, this thesis emphasizes on the baisc rights that vest in the condemned criminals. The legislation on the condemned criminals' human rights in the International Human Rights Law forms the foundation of this thesis. After analyzing and comparing the international legislation on the protection of condemned criminals' human rights and the current situation on the protection of condemned criminals' human rights in China, this theis comes to the conclusion that the current state legislation on the protection of criminals' human rights in China should be modified in aspects of legislation, procedure and justice. Further, with an effort to build up a new protection structure of condemned criminals' human rights in China, this thesis has put forward some constructive suggestions on the improvement of legislation, procedure and justice thereof.
