The Legislation Thinking Of Establishing "the Crime Of Disrupting The Order Of Housing Development"

It is great significance to achieve the protection of the citizens’ right to house, promote the development of economic and social, and safeguard the stability and unity of the society of the good order of the housing development. Since the reform and opening up, China has made a great achievement on the strategic objectives in achieving the "Home Ownership", but there have also been some dangerous vandalism. The vandalism not only upsets China’s housing development order, interferes with the management activities of the state housing development, but is also against the housing rights of citizens. Although China’s housing development management system is established by the laws of the administration, civilization, and economics, the mandatory punishment is not enough to curb the illegal activities. Crime on the behavior of the serious damages to housing development order has not taken seriously enough yet, and in the Criminal Code, these are not any crime provisions about the disrupting of the order of housing development either, which show a certain lag in the legislation, and even legislative gaps. In order to improve the order of legal protection system of China’s housing development, the order of the housing development should be incorporated into the scope of the Criminal Law’protection, and provide a strong legal protection to the order of the housing development. This article analyzes the problem of the criminal law protection of the order of the housing development, and proposes the legislative proposals about the crime of disrupting the order of housing development in the entity. The proposal is to establish the crime of the disrupting the housing security, the illegal housing transaction, the illegal hoarding the land of the construction of the housing, the false information of the housing transaction.
