Recently,people in china question about the justice of judicature because the casesabout unfair judicature often are reported in the newspaper and internet.The causes of thephenomenon are in not only the expansion of the medium but also the still existence ofcase of the relationship. Judge often send interest to his relative as a lawyer.Under thisbackground,in order to ensure the justice of judicature,strengthen the credit ofjudicature,the supreme court issue the notice about the evasion of judge from theprofession,demanding the evasion of leader and judge in the court whose spouse and sonand daught are lawyers in the same region.Although the regulation has some effection,it has the question about the law,normand justice in the limitation of profession in the law.The machinemade of secession on oneside about easion of judge from the profession is a new question in the judicial domainlearning’feild still don’t study systematically,though the medium issue some shortcomment.This article preliminarily study and rethink this question and put somesuggestion.
