The Research On The Minnority Environmental Protection Customary Law At West Region Of Hunan

With the constant development of the economic, our country is faced with more and more environmental problems. Although Our country have formulated a lot of environmental laws,but still do not resolve the growing environmental problems.From our country current environmental situation, Most of the areas’environment have been suffered different kind of pollution and destroy, at the same time, the minority of western of Hunan province still keep much more original environmental features, and realizing the human and natural balance. This in large degree can attribute the success to the area’s good working of the environmental customary law.The customary law containing affluent zoology ethical ideals make a positive meaning in protecting the local environment, keeping zoology balance, and protecting the species diversity. Due to its flexibility and concreteness,the environmental customary law compensates for the statute law in local production and daily life,which has a characteristic of abstract and macroscopic.One of the part of the customary law not only can apply to the tradition society, but also make a positive meaning in the modern times.This article is based on the existing customary law of minority research,its indeed for us to research the local customary law about the form and contents, and to summarize the character and function, also to study the process of the thousands’ practices,to make a rational analysis of the future of customary environmental law of west of hunan. The purpose of this paper is to make people realize the our traditional law---Minority customary environmental law in the process of modernization of the rule of law,also to show constructions of Minority’s Customary Environmental Law which should be fully respected.Only we coordinate the Customary Environmental Law and the National Law can they servesthe eco-environment law cause of our county. This have positive constructions to build the societyof good-realationship between people and nature.
