Employment Crime has long history. Employment Crime is a special form of jointcrime, in addition to its general characteristics of joint crime, Employment Crime alsohas its own characteristics. Generally speaking, employers do not directly control thebehaviour which constitute the element of the criminal fact, but through the behaviourof the abetted people to reach the criminal purpose. Because each conspirator’spersonality is independent, there are often some problems, such as disagreement ofconspirators’ intention, limitation of criminal object and target of crime as well asfactual errors, all these would affect the sentencing of conspirators. Usually, there areseveral conspirators in Employment Crime, such as instigator, assisting offender andperpetrator and so on. Whether abetting or implementing is primary, it is meaningful forsentencing of conspirators and undertaking legal responsibility. In order to overcomethese above problems, I address these issues through a comparative study of foreigncriminal law theory combined with the case in judicial practice.
