The Real Right Claim

The right of the real claim derived from ancient Rome，in which the right of thereal claim had its primitive form. It had developed in the law of France and finallyconfirmed in the law of Germen. The right of the real claim，which is the claim rightbased on jus reran，is the right that the real right owner asks the relative person to do ornot to do certain act, which is to eliminate the obstruction or danger, restore the Perfectstatus of the real right in the infringement or danger. The condition and the effect of theexecution of the claim right in ram vary with the categories of the claim right in rem. Itis not adaptable to set the Provisions of the acquisitive Prescription and the limitation ofthe actions.
