United States is one of the most completed countries inintellectual property protection, and also the largest tradetransactions of China. However affected by multiple factors,intellectual property protection in China has been the weak linkfor a long time. After joining the WTO, intellectual propertyprotection in China has been unprecedented linked with foreigntrade. There is no doubt that, the trade of China with the U.S.will be subject to the threat of the United States on intellectualproperty law. And in all laws of the United States on intellectualproperty protection, the U.S. trade law337is the hardest onein striking other countries. Because of the historicalbackground of the section, it was born to bear against foreignenterprise’s mission to protect domestic industries. In view ofthe337is treating to China’s foreign trade, so that toresearching337is particularly important. Now, there arealready a lot of researches about337, but most of them are the provision itself, and rarely discuss from the perspective ofChina’s enterprises. So in this paper we first introduced thesection337, and then on the basis of contrasting the term withother terms to analyze this section further. By case studies,we focus on response to Section337of U.S. trade law. With aview to the future, I hope this paper will play a role in thetrade between China and U.S.,and to safeguard the interests ofour enterprises.
