The rejection of the EU Constitutional Treaty and the success of the Reform Treaty had made the Constitutional Treaty less important and less meaningful in most opions’. But, the truth that the Reform Treaty is only a replacement and it’s aim is only to save the failure of the Constitutional Treaty must be properly attended. that means, the Constitutional Treaty is much more close to the ideal form, and the Reform Treaty is more or less a compromise, though the latter one have achieved some great and obvious success. In this paper. the author studies the Constitutional Treaty and the Reform Treaty as an integrated event in the background of the history and practice of European Integration.The Reform Treaty has achieved far more in the EU institutional reform than the symbolic meaning. But the reformed one of the Reform Treaty, Constitutional Treaty, should has done great much symbolic work to foster the constitutional patriotism among the European Citizens.The lack of the effective of construction of European Collective identity made the Reform Treaty an unfinished reform. so there is still much to do in the future for the European legislation to fulfill the task of creating the European Collective identity and fostec the constitutional patriotism among the European Citizens. To some extent. the Constitutional Treaty offered a model to achieve the original goals, though the model-is not perfect.According to the reasons mentioned above, the study on Constitutional Treaty is not out-dated, and will be critical to understand and predict the EU and EU laws’ future. This paper will the introduce the history of the European Integration in the first part; and will analyze the constitutional meaning of the Constitutional Treaty according to its content in the second part; analyze the change the Reform Treaty had made to the Constitutional Treaty in the third part; reveal the importance of the Constitutional Treaty in the sense of the construction of the European Collective identity and the foster of Constitutional patriotism at the base of analyze of the two treaties’effect to the EU constitutional structure in the fourth part.
