The Subsidiary Criminal Law is to adjust the special social relations, although they also can be adjusted by criminal law or separate criminal law.On one hand, this kind of social relations’involving all aspects of the social life results in the invalid of the criminal law in adjustment to these social relations.On the other hand, the current situation calls for the indispensability of the law to regulate these social phenomena.To such a requirement, the Subsidiary Criminal law was made.The legislation of Subsidiary Criminal Law is an important part of criminal law legislation all over the world.A complete and scientific mode of Subsidiary Criminal law legislation is not only a significant symbol for highly perfection of its penal code in a country, but also a reflection of the level of criminal legislation.However, China’s Subsidiary Criminal law has its limitations and the implement is also unsatisfactory, especially in such aspects as the legislative mode techniques interpretation and process, with some flaws of the system.Therefore, in view of China’s present national conditions and legal situation, the legislation on how to systematically perfect our country’s Subsidiary Criminal law has great theoretical and practical significance.This paper consists of five chapters on the structural composition.
