Study On Law Application Of Foreign Same-Sex Relationship

Many countries have already legislated on same-sex relationship, in these countries, same-sex relationship can be recognized as marriage, registered partners or civil union; otherwise, and some countries allow foreigners to legalize their same-sex relationship in their countries. Due to various domestic laws and some countries are still blank space on same-sex relationship legislation, on one hand, it easily leads to same-sex relationship "upgrade" and "downgrade"; on the other hand, since most countries have not yet to legislate for same-sex relationship, foreign same-sex relationship are inclined to invalid. In these cases, not only the legal rights of same-sex partners are neglected in the world scope, but also easily lead to the negligence of the legal rights of the States and its people. Therefore, it is very important to analysis and research on the law application of foreign same-sex relationship to find the way to solve the problems to make respond to the world human rights movements, ensure the legal rights of the States and its people and promote the law process.In this paper, it makes a detailed and comprehensive study on the legal protection of same-sex relationship at home and abroad, analyzes the problems in the process of law application of same-sex relationship and proposes the solutions. More importantly, it supplies the outline to the law application system of same-sex relationship, and plans a series of situation to exclude the application of the domestic reservation of public order in the position of the China and its people’s privilege, in current situation, it is very practical.
