| With the development of science and technology, the role of computer software in the society is more and more important. Since the sixties of last century, the legal protection mode of computer software was been proposed at first time, the debate of what mode should be taken on the protection of computer software had not been stopped yet. Due to many factors, most country of the world finally take copyright protection mode, but with the rapid development of software industry, the inherent defects of the copyright protection mode made it suffered more and more queries. And the history of the development of the legal protection of computer software showed copyright protected mode is not the only option. Based on the review of the legal protection mode of computer software history, and the analysis of several important factors that can influence the selection of computer software legal protection mode, the article make a comprehensive comparison among the existing software legal protection mode. Now our country is in the rapid social development, various industries need the revolution of law, and the level of Chinese computer industry is low. Although the adjustment of the legal protection of computer software model is imminent, if we change the existing protection system too much, it is not only a waste of the existing legal resources but also can not guarantee the quality of the specific legislation. To improve efficiency and save the legal resources at the same time,, we should make full use of existing resources to absorb on the merits of the legislation in force to integrate and establish this as the basis of legal protection for the entire computer system to determine a direction and goals, operational system to be adjusted to the harmonization of the various legal systems, and play the effectiveness of the integration of resources, the present stage should take special law to protect the multi-method protection of computer software legal protection mode. |
