Infringement Act And Damages Compensation Of Internet Copyright

With the fast development of network technology, internet approaches into people’s work, study and life. Network technology brings convenience to people’s lives, but it also impacts on the existing system of copyright protection and consequently produces many new problems in the trial practice. Massive information-sharing on network and low-cost copy features make the prevalence of violations of the copyright act. All of these make the right protection in cyberspace extremely urgently. This article will make preliminary analysis for infringement issues in cyberspace for network copyright. This article is divided to four parts. The first part focuses on fundamental theory, including definition and characteristics. The second part focuses on infringement act of Internet copyright, including infringing form and infringing characteristics. The third part focuses on the principle of damages compensation. The fourth part focus on some suggestions of the accountability judgment in Internet copyright infringement case, improving the existing network of copyright legal system, law enforcement uniform scale trial, and improve evidence preservation system are included.
