Reseach On The Right To The Contracted Management Of Rural Barren Land

The right to the contracted management of rural barren land is widely supposed to be a kind of usufructuary right in terms of related rules and regulations, while an ongoing theoretical debate still exists, whether it has the nature of real right or obligatory right. The right to the household contracted management of land and the right to the contracted management of rural barren land, are known collectively as the right to the contracted management of land. However, there are many differences between them. This thesis attempts to figure out and summarize these differences through discussing the main issues such as the subject of right, the right of disposal, the creation and termination of right.This paper is divided into four parts to discuss the contracted management of the rural barren land. The first part of this paper discusses mainly the nature of the contracted management of the rural barren land. The second part discusses mainly how to get the contracted management of the rural barren land. The third part discusses mainly how to exercise the contracted management of the rural barren land. The last part discusses mainly extermination and recycle of the contracted management of barren land.
