Study On The Establish Ment Of The Right To Contract Management Of Rural Barren Land

Rural barren land contractual management right is a kind of rural land property rights is very important,the establishment of a sound system related to uncultivated land development effectiveness and related rights interests.This paper from the definition of rural barren land contractual management concepts,characteristics and the way of setting up of the analysis of the existing rural barren land contractual operation right of land contracting loopholes in the procedure,and to explore the effectiveness of rural barren land the right to the contracted management of land registration,finally puts forward some improvement suggestions.The first part defines the uncultivated land,the object of rural barren land contract management rights are analyzed by comparing the definition;secondly based on household land contract management rights,introduces the concept and characteristics of rural barren land of the right to land contractual management regulations;finally reviewing our current law rural barren land contracting right to set up a program.The second part mainly studies some problems of contract four land contracting right concluded,such as the rural barren land contracting right three establishment mode were described,and the analysis of the characteristics and the way of setting up the legal loophole three;in addition,this paper also studies the problems and conclude the democratic process and the government approval the contract also analyzes the two program in law and the problems in the operation.The third part mainly studies the rural barren land the right to the contracted management of land registration problems.On the "property law","rural land contract law","Supreme People's Court on the trial involving rural land contract dispute case.applicable legal interpretation" problems relating to rural barren land contract right registration provisions were studied,analyzed the conflict between them.In the fourth part,the author puts forward some suggestions on the related issues of the conclusion of the second part of the contract and the validity of the third part.
