The Theory Of Family Court System

In this paper, there have three aspects of the content to expatiate the system of the family court, a summation of the family court; a series interrelated system of the family court from other countries; the significance to found our family court system and a macroscopically idea for establish it in china.The first part, start from the concept, explained the object of study of the family court, it is family cases. Then explore the origin of the family court and development process, based on the characteristics of the family cases and the classified research, make a legal analysis, then educe the conclusion that family court has its own unique properties, function and value.The second part, through the inducing and anglicizing the content about the family court in other countries, expatiated several family court systems more concretely, such as the classification of the modes that found the family court; the jurisdiction of the family court system; litigation system and trial system; the main structure system and so on.The third part, through the research of the development and changes in family cases, and the analysis on the situation of the trial system, pointed out its problems, discussed the necessity and feasibility of establishing family court system in china on this basis, proposed a macro vision of founding family court system in our country, in order to build a multi-layered, resultful family court system on the basis of following certain principles and guidelines.
