Indian Mahatma Gandhi ever said that we can judge a country and her morality from her attitude toward animals. Animal is a partner in human being’s life and a indispensable component of the nature; however, animal’s living conditions are not optimistic in China. In recent years, torturing animals occurs frequently such as graduate in Fudan university torturing cats, students in Qinghua university hurting five wild bears with sulfuric acid, and slaughter households injecting water into live pigs in order to increase the weight. Therefore, nation, society, and individual have to think about this series of animal cruelty rationally after occurring.Some western countries such as Britain and America pay close attention to animal welfare issue in earlier times, so advanced and complete animal welfare laws has been formed after long-term effects. As the first country proposed animal welfare laws, Britain has the most comprehensive animal welfare laws in the world. Thus, China can consider British animal welfare laws and specific regulations about companion animals, farm animals, laboratory animals, and wildlife as references. Although China already issued a series of animal protection laws and regulations, these laws and regulations cannot form a complete animal protection system. In short, the current animal protection laws in China can achieve satisfactory results.The passage clearly defines the concept and classification of animals first of all, and then proposes animal welfare theory and main concept of animal rights theory. The passage summarizes and analyses the differences. We get a conclusion that animal welfare theory is the right direction of protecting animals, through analyzing infeasibility of animal rights theory. After clearly making animal welfare as legislation direction, the third chapter introduces British classical Animal Welfare Act according to law classification of animals, and gets the advanced concepts and rules out of analysis. Then the passage introduces laws and rules in China related animal welfare, and compares with British Animal Welfare Act. Thus I think there is some insufficient on law-making related animal welfare in China. The last chapter firstly analysis the necessities and feasibilities of optimizing our animal welfare legislation, and proposes views to modify. The country should rather pass the Animal Welfare Act to assurance the basic rights of animals, than completely copy other countries acts with ignoring our development at present stage. We should not accept the concept Animal is not just animal. It does not only strengthen the senses which citizens protect environment and animals, but also restrict and punish the actions of cruelty to animals. That would offer new motivation for continuous developing of our economics and society, to satisfy the demands of developing trends of global environment protection.
