Economic layoffs is one way to improve the production and management of the company to dismiss part of labors. It is a special form of notice dismissal and no-fault dismissal. Economy of layoffs is a result from conflict between business autonomy and workers’ right to life. Economic layoffs system will affect the interests of both enterprises and workers, and even affect the overall interests of the community. Chinese economic layoffs system is too simple because of the legislative provisions, many reality of the problem in the economic layoffs is not implemented in the specification, and it lacks of operability. There is a certain degree of the problem in the real elements of layoffs of Chinese economic layoffs system, program elements, restrictive elements, social programs and corporate legal responsibilities, which is not conducive to protecting the legal rights of workers or the legitimate business reasonable staff efficiency. Therefore, the improvement of Chinese economic layoffs system, especially improve the legislative means, will have great significance of the protection of the interests of both employers and employees in China and maintain harmonious and stable whole society. Comparative analysis of the legislative system of foreign economic layoffs, five aspects should be improved in the Chinese economic layoffs system, including the substance elements, the program elements, the restrictive elements, the social plan and the corporate liability.
