Theft with lethal weapon is a circumstance of crime added newly to The Eighth Criminal Law Amendment. Though the criminal law has made a rule for such crimes, there are no clear rules witch regard to the range of carrying. Generally speaking, carrying refers to a kind behavior of taking some item with or around someone and putting it in practical control in places outside the house or room where he engages in the daily life. The identification of carrying in the thefts with lethal weapon is not such strict, just evaluated as carrying instead of demanding the possibility of lethal weapons used at any time. According to different standards, the pattern of carrying can be divided into direct carrying and indirect carrying, express carrying and hidden carrying. The identification of carrying varies from the patterns of carrying. There are many factors affecting the identification of carrying including the quality of lethal weapons, time, space and subjective cognition of actors etc. In a joint crime, the identification of carrying is much more complicate.
