Housing Tenant Right Protection Research

There two models of low-rent housing in China, one is" only rent but unsold" model, the other is "property right to share, rent and sale" mode. The two models of low-rent housing supply each other, and perfect for the housing security system of China. However the current low-rent housing management regulations involved tenant rights is not much, and the legal protection of tenant right is not got enough attention. The limit and dispute about legal nature of tenant right make the protection of tenant right more difficult. This paper is divided into four parts:Part Ⅰ Comments on current model of low-rent housing. This part introduces the development of low-rent housing and the present situation of tenant right protection in China. It involves the low-rent housing connotation, characteristic and two different security models, and some brief comments.Part II Legal nature and content of tenant right of low-rent housing. In different model, content is different. The tenant of low-rent housing should have the independent option to which model of low-rent housing he can get.PartⅢ The protection of tenant right during the lease term. In the first part there are four aspects:the established time of the tenant right, perfect the system of public low-rent housing, the right of lease termination veto, compensation right. The second part contains the share division of low-rent housing, the management and utilization of the house, etc.PartⅣ Exit mechanism of low-rent housing. In the exit mechanism there are many phenomena which violate tenant rights, such as error deprived the lessee qualification, lack of incentive mechanism, etc. We should establish a sound system of exit mechanism for low-rent housing, make the information about low-rent housing publicity; Establish the sequence of housing safeguard undertake; Perfect low-rent housing legislation, clear up the right in exit mechanism.
