On December2008, the General Assembly of the United Nations adopted the United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea, which is also called the Rotterdam Rules. Until the October2011, there are23countries, including the United States, Denmark and France have signed this agreement. The purpose of the Rotterdam Ruler is to establish unified rules of international maritime transportation. China is a big maritime country, the development of the maritime industry has a significant influence on its economy. The "right of control" as the essential innovation introduced by the Rotterdam Rulers has become the focal point of academic discussion. This dissertation will be focused on the "right of control". The whole article consists of four chapters as follows:The first chapter is introduction. In this chapter, the author will illustrate the concept "right of control" on sea transportation through analyzing the studies in current international conventions.The second chapter will discuss the value of the right of control. The author considers the right of control has direct and long-term impacts on transportation industry significantly. Firstly, it could directly relieve the problem of delivery cargo without production bill of lading. Secondly, it could push the traditional international trade forward to the electronic age.The third chapter will study the contents of "right of control" in the Rotterdam Rules and compare it with other maritime or non-maritime transportation regulations, in order to elaborate the insufficiency of the Rules and provide suggestions.The fourth chapter will state the reasons of why China should bring the right of control in the China Maritime Code. The author suggests that the Rotterdam Rule has significant influence on the sea transportation, and based on the China’s current legislation, it is crucial to apply the "right of control" into the Maritime Code.
