Study On Administrative Recovery System

Administrative recovery system is the important content of the national compensation system, the system of standard and perfect, On the one hand in favor of supervising the Compensation authority to recourse according to the law, On the other hand to maintain the lawful property of recourse by people, Is to should have the meaning of promoting the administration according to law and building law of the country. From the start that our country introduces the administrative recovery system, we have made some achievements in the construction of the system and development, along with the national compensation law and its implementing regulations promulgated, our country’s administrative recovery system steps on to a new stage, but the construction and implement of this system, whether in theory and practice has many problems, leading to the administrative recovery system is on the shelf. So to further improve the administrative recovery system become one of the important work of law construction, this article tries to put forward the suggestion to perfect our country administration recovery system by basing on discussing the basic theory of administrative recovery system, the current law, combining the experiences of foreign countries.This paper will be divided into introduction and the key text. This introduction mainly introduces the research background, foreign studies of price hearing system and the research thinking of the thesis. The key text includes four chapters. The first part is about the basic theory of administrative recovery system. The contents of this part includes the properties, characteristics and theoretical basis of the administrative recovery, among them from three aspects discusses theoretical basis of constructing the system of administrative recovery; The second part, the author introduces the development situation of the administrative recovery system in China from two aspects of the legislation and practice simply; The third part, the author analyses the current problems in the system of administrative recovery and discusses the causes of the problem, and probes into the necessity of the development of administrative recovery system; The fourth part, on the basis of analysis of the problem, Learning from foreign advanced experience, put forward the idea to improve our administrative recovery system from four aspects.
