Research On China’s Administrative Recovery System

With the continuous development and progress of modern democracy and the rule of law,the administrative compensation system is also born.The introduction of the administrative compensation system can be said to make an important supplement to the state compensation system and further improve the state compensation law.The establishment of the system of administrative recourse has a strong supervision and warning effect on administrative law enforcement personnel.Law to give citizens’ rights,has also asked citizens to fulfil obligation,administrative law enforcement personnel within the system,the more should be law-abiding,strictly abide by the law,if a crime,shall be investigated for responsibility and accountability for the way there are two types,one is property liability,is a kind of property liability,property liability way relatively more alert.Administrative recovery,as the name suggests,is the pursuit of money responsibility,that is,property type of accountability.At the fourth plenary session of the 18 th CPC central committee,it was proposed that "public servants should administer according to law,actively implement the responsibility system for law enforcement,and strive to build a law-based government." Administrative compensation is a way to punish the wrong administrative personnel,a practice of administrative law enforcement responsibility system,which is conducive to the overall construction of the government under the rule of law.However,the system of administrative recourse has not been well developed since its establishment,and there are many problems in the implementation process,such as the implementation and supervision of the system.Therefore,the implementation of China’s administrative compensation system must be paid attention to,from the start to the implementation of each step should be well checked,the implementation of supervision,supervision of administrative personnel to strive to do according to the law,do not exceed the power of the law,let the recovery system to play the greatest role.
