Research On System Of Execution In The Wto Dispute Settlement Mechanism

The WTO dispute settlement system is one of the major achievements of the Uruguay Round. DSU set reversed consensus rules to ensure the WTO dispute settlement runs smoothly, so the complaining party could get the DSB recommendations quickly. When refers to the implementation system, DSU set the reasonable period of time system, the review system, and the compensation system, as well as the retaliation system to improve the implementation of the DSB recommendations, but the implementation of the DSB recommendations are still one of the main problems in the WTO dispute settlement practice. We must comply with the following purpose in the process of modification:any proposal to amend the system of implementation of the WTO dispute settlement mechanism must be based on the actuality of the International Political Economy. The ultimate goal is to enforce the liberalization of the trade and protect the trade interests of all Members.The WTO dispute settlement system is worked well now, it is essential for us to improve and strengthen the rules and institutions. This paper has four parts about the implementation of the WTO dispute settlement system. The contents are as follows:In the first part, we review the history of the WTO dispute settlement system and expound the WTO dispute settlement system and implementation problems related to it.The second part involves in the content of the implementation of the WTO dispute settlement system. It contains the reasonable period of time system, the review system, the compensation system, as well as the retaliation system.In the third part, there are some suggestions about the problems about the implementation of the WTO dispute settlement system.The forth part is mainly involved in the actual situation of China’s participation in the WTO dispute settlement and the future position in the WTO dispute settlement system.
