Thoughts On Criminal Witness Protection System In China From The Perspective Of Judicial Justice

The testimony of witness is very important evidence in criminalproceedings, and it is the fundamental guarantee for checking the case toappear in court as a witness in criminal proceedings. But at present criminalwitnesses’ refusing to testify in court and the current situation withextremely low rate in our country has greatly affected our country’scriminal procedure and substantive justice. After investigating the reasons,we found that the most important one is that the personal and property safetyof the criminal witnesses, especially the witness for prosecution, cannotget effective protection when they fulfill the obligation of witness. It isthe result of our current legislation and the system of witness protection’sweakness. The article investigates the fundamental reasons of the criminalwitnesses’ rejection for starting, analyses the criminal witness protectingsituation, compares with the laws and practices of the witness protectingin other countries, combines with our existing legal system and nationalconditions, and draw lessons in witness protecting from South Africa,Britain, the United States, Hongkong and other countries to design asuitable system of witness protecting for our country to provide a usefulreference for perfecting our country’s witnesses protecting system.
