Along with social progress, human dignity and human values are increasingly respected,and the short-term imprisonment in line with the general development trend of Penalty andthe protection of human rights. This article, in the basic idea of defining the concept ofshort-term imprisonment and the comparative study on short-term free-punishment system inChina and Russia, in order to find the problems in both countries. And further combining withthe main problems in China’s short-term free-punishment system both in theory and practice, Imake some suggestions, in order to achieve the purpose of improving the protection of humanrights in China.This paper uses the methods of historical interpretation and comparative analysis,consists of five chapters. The first chapter comes up with clear concepts and basic concepts ofthe short-term imprisonment; The chapter II puts forward writer’s views after analyzing thedebate of the short-term free punishment. In chapter III, I compare the historical evolution inChina and Russia. And the chapter IV finds some problems through comparing legislation,judicial application, law enforcement, and summarize experience and lessons from Russia.The last chapter proposes specific suggestions on improving the short-term imprisonment inChina.
