There is s newly rising issue of research on the environmental administrative hearing system,which locates on the threshold of both the theoretic and practical areas in our country. By makingthe civil rights, governmental power and environmental interests fairly relevant, this system is acrucial approach to balancing the benefits among the public, the government and the environment.According to relevant laws and regulations as well as well-known hearing cases, the paper isanalyzed our country’s environmental administrative hearing system from the perspectives of legalsystem and case study.First, this paper shows a clear direction and value of study by the general overview on theresearch topics, methods, theoretical and practical significances. Then the fundamental concepts,such as administrative constitutionality environmental justice, environmental security, is exploredas the academic analysis of the environmental administrative hearing system. Therefore, the writeranalyses legal value of the system, including the program value and entity value. In order tocombine the theory and practice deeply, the paper gives a systematic analysis aboutimplementation and application in the real by some specific cases. Not only the advantage of thesystem is seen, but also there are its shortcomings from environmental legislation, the specificdesign of regulations, ideas of the administrative body and participants. At last, the paper raisessome imaginations and suggestions from the legislative level, concrete regulation and idealisticchange.In a word, the paper takes up the systematic study of the hearing system in several angels toaccelerate and innovate the environmental administrative hearing system of our country.
