Study On The Problem Of Service Period

Since2008the system of Service Term as an important system in <labor contractlaw> formally launched, it became a controversial question between theoretical extentand practical extent. The argument of service term liquidated damages, deadline or some training fee during the practice. Basically, these arguments were all related to thelength of service period. And on the current legislative situation it was blank on theseissues.All the troubles between labor and management that caused by the problemhave already departed from the original intention when the service period made. Howto face this problem and solve it become the main point of the service period system.In this article, the problem of service period deadline is the point cut. It combines the research of Taiwan and German cases. Meanwhile, analyzes some related issues thatinvolved in theory and system, point out my own view and suggestions. Wish it canhelp to improve current situationChapter One analyze the concept and the effect of service period, providingacademic basis for following research. Chapter Two the comparative analysis ofservice period deadline, labor contract deadline, Noncom petition deadline andprobation period deadline. According to the problems, making suggestions and alsocompare with Taiwan and German. Through above analysis have a deeper cognitionon the legal nature of service period deadline. Chapter Three analyze current situationabout the defect of service period deadline system, providing own opinion and thenecessary of improvement. Chapter Four based on above analysis providing somelegal system consideration and legal reconstruction suggestions.
