In the era of knowledge economy, talent competition is the core of competition between enterprises. How to attract, nurture and retain talent, become the important content of enterprise human resources management. Service period of Labor contract is the workers agreed serving the duration of the employer after the employer providing some special treatment for the workers. The system not only can promote the employer to increase investment in human capital, and promote personnel training and technological innovation, but also to protect the employer return on investment in human capital, enhance their market competitiveness. The inflexible service stage system in Labor Contract Law, however, go against the settlement of dispute and restrict its role. This paper consists of three parts:The first part outlines the basic theory of service system. To clarify the concept of service system, the difference with other related concepts, and the legal characteristics of service contracts.The second part judges the current service system. On the basis of combing legislative history of service system in China, points out that the service period legislation is the strong demand for project management and trial practice, has a far-reaching influence on the harmonious and stable labor relations.The third part demonstrates how to improve the system of service period, proposed some modification suggestions. Finally puts forward some suggestions to solve specific problems encountered in the trial.
