In December,2010, the Jasmine Revolution which began in Tunisiahas an important influence to the region of North Africa. Just in a fewmonths, Egypt, Libya and other countries have been involved inpeoples demonstrations tide. Eventually, the iron triangle regimeexisting in the politics of North Africa collapsed in succession.Among the political turmoil, it is typical to find the solution to theLibya problem. With the changes of the situation in Libya, the UnitedNations Security Council have been adopted the resolutions of No.1970and No.1973to deal with the question of Libya. The new features andmanner which is showed in the solution are worthy of our attention, andthis article will interpret from the perspective of international law.There are mainly three aspects in dealing with the question of Libyawith the United Nations. The first aspect is the establishment of no-flyzone in Libya.It’s authorized to take action to protect the interests ofthe civilian population. This is the first "limited authorization" of the UNSecurity Council. It ruled the action objectives, methods, and reportingsystem and so on.It got a lot of praise. But it is also questioned by the"legitimate" acts of interference in the internal affairs. Therefore, it needto improvement of the oversight mechanisms and so on.The second analysis is about the recognization of Government."CIAT" got the legitimate representative of Libya at the United Nationsthrough the ballot,though it not yet completely ruled Libya in thecountry. This result is controversial to the principle of “the rule in fact”.The admition of Libya is special.It is more worthy of our consideration tohandle “the procedural legal” and “in fact rule”.The third analysis will focus on the International Criminal Court arrestthe former leader of Libya, and on the human rights which isinvestigated of the International Criminal Court.In this paper, according to the analysis of international law,it is believed that the InternationalCriminal Court is lawful to the Libyan former leader of competentjurisdiction, because the UN Security Council adopted resolutions of No.1970. The cooperation of UN Security Council and the InternationalCriminal Court is a good practice.Until today, North Africa Council is still in turmoil. The United Nationsdrew on the mistakes in dealing with the question of Libya, the UNSecurity Council has a more cautious attitude in dealing with Syria.
