The issue of prisoners’ human rights is not only a long-lasting topic but also an important standard to measure the level of a nation’s human rights protection. Protection of human rights of prisoners has been subject to widespread concern of the academics. The human rights of prisoners refer to various basic rights everyone should have as a human being apart from the rights deprived in accordance with the law during their prison service. Proceed from the concept of prisoners, human rights, the prisoners’human rights, basic human rights, fundamental right, and based on the theory of three forms of expression of human rights, this essay contrasts the natural right, statutory right and actual right of prisoners in China with rights stipulated in international human rights conventions, in particular in Standard Minimum Rules for the Treatment of Prisoners and then points out the shortcomings in protection on prisoners’ human rights in China and also indicates some suggestions and tips that should be noted in the process of improvement.
