The minor children of prisoners in prison is a fairly weak group.Due to various reasons,this special crowd of economic constraints,the lack of education over the sky,the spirit of emptiness,the future slim.The law on the protection of human rights in this part of the population is extremely vacant,so that prisoners are not adult children can not be guaranteed.Itself is not grown is a critical moment,and serving personnel of the minor children relative to other families of minor children for more social harmfulness,the rescue and protection of this special group is the hot issues of concern to society in recent years,served on the staff underage children's human rights protection is not only related to the smooth growth of these minors,but will also affect to they are serving their transformation,and even involve the stability of the whole society.This thesis starts from the concept of the right to life,the right to receive education,and makes a systematic exposition of the prisoners' minor children's human rights can not be guaranteed causes,mainly from the legislative vacancy,the relief system is not perfect,government supervision is not in place is discussed,and aiming at these problems,using comparative analysis and practical analysis,literature analysis method,empirical analysis on existing problems put forward corresponding countermeasures,on the one hand is the legal protection,improve related to legislation in the field,on the other hand is to establish a sound social relief system,whether it is government supervision and social security are to set up a complete system.At the end of the paper,the author's point of view,will serve a sentence of minor children included in the scope of state aid and amend the current guardian system to protect the minor children's rights of prisoners.
