But, because the rural endowment problems relates to all aspects of the social relations, we will not solve the rural endowment problems simply relying on the research in a particular field, besides, many scholars ignore the importance of the commercial insurance in the rural endowment problems and most of the scholars study this problems from the social or the economic perspective rather than the legal angle. Therefore, under the background of the shorting in the social basic endowment insurance and collective compensatory endowment insurance, the author put forward the suggestion that we can take good advantage of the commercial insurance and promotes the rural commercial endowment insurance system to solve the rural endowment problems.The rural commercial endowment insurance system is a newly rural endowment insurance system; it has both social and commercial properties; it is an important supply to the newly rural social insurance system; and it can provide technical and management support to the newly of rural social insurance system. But, we should realize that we will meet many difficulties in promoting the rural commercial endowment insurance system due to the influence of various factors, for instance, the shorting of effective legal support. the lower awareness of the rural residents to the insurance, the worse situation of the present insurance industry, the shorting of multi-level supervision system in the rural commercial endowment insurance system. the higher price of the rural commercial endowment insurance. Both these factors have seriously hindered the development of the rural commercial endowment insurance system. To solve the above problem, the author thinks that our country should take step gradually on the basis of the realistic situations of our country, and we must promote the rural commercial endowment insurance legislation which should combine the principle and flexibility, the stability and forward-looking, evenly we should make sure the position of the rural commercial endowment insurance in the whole legal system to provide legal support for the rural commercial endowment problems. Because the farmers is the disadvantaged group in our society and the have less knowledge both in insurance and in law, so the author thinks that we should reduce prosecution conditions in the controversial rural commercial endowment insurance, bringing the unfavorable interpretation principle and the judge’s power to clarify into full play in justice, giving priority to the rural commercial endowment insurance case in the process of the execution, so that we can protect the farm groups. Besides, the author argues that the rural commercial endowment insurance has both commercial and social double properties, so we should perfect the regulation law and establish regulators and its responsibilities to strengthen supervision and management of the rural commercial endowment insurance. In short, in the problems of the rural endowment, we should jump out the frame of the social endowment insurance and implement the rural commercial endowment insurance system, which is the only way to solve the rural endowment issues and this is also the main idea of this article.This significance and innovation of this thesis are:the first of all, in the rural commercial endowment problems, the research of economics and sociology never stop and its theory system gradually perfect. But there are few scholars have combined the rural commercial endowment insurance and the legal system to study. The author put forward the idea that we should implement the rural commercial endowment insurance system from the legal angle, in order to make some innovations. Besides, the author also discusses the problem that many scholars have long been ignored, that is, the position of the commercial insurance in the rural pension security system, the author has realized that the commercial insurance is an important part in the rural pension security system and the rural commercial pension insurance both have social and commercial and it is an important supplement to the new rural social pension insurance system. All in all. The author hopes that the thesis could arouse further study of the rural pension problems through the author’s superficial idea, so we can provide the establishment of the rural commercial pension insurance system some options, and eventually give the solution of the rural pension problems hindering the development of the society.
