The Confirmation And Protection For Citizens’ Right Of Euthanasia

Euthanasia has been disputed fiercely by people in the world, and the experts and scholars in different countries have put forward a variety of different opinions. Holland has already passed bills related to the euthanasia in April2001, becoming the world’s first country which brings euthanasia into the legal system of the country. Following Holland, Japan, Switzerland and the State of Washington, Oregon and so on have adopted the relevant legislation of euthanasia. Euthanasia has been an important civil right and it has been in the strict legal regulation in these countries. Euthanasia law in these countries should able to provide valuable experience for drawing up law of euthanasia in China.In our country, many far-sighted people including the late Comrade Deng Yingchao and Academician Wang Xuan have been making a sustained effort, they have been put forward suggestions about the legalization of euthanasia. Besides personal and some organization institutions have suggested the legalization of euthanasia, since1987years up, there were some deputies to the NPC have suggested that our legislature should brings euthanasia into the legal system of china in NPC and the Standing Committee, however, because our legal construction is not perfect enough and euthanasia is faced with huge pressure in ethics, so Chinese legislature still have not worked out the bill of euthanasia until now, euthanasia in China still belong to the legislative blank field. But the reality of our society is that incurable disease patients request euthanasia be enforced on them and disputes involving euthanasia and other similar cases frequently occur, the lack of euthanasia law has been a shock board for development of our country’s legal system. Therefore we need to enforce the legalization of euthanasia in China as soon as possible, making the ownership of euthanasia clear in the form of legal and strengthening the protection of citizens’right to euthanasia, it should be inescapable responsibility to us who be engaged in legal specialty.The main content of this thesis is divided into three parts, the main content of the first part is the necessity of confirming euthanasia for citizens" rights,which including confirmation of euthanasia’s concept, the problem of carrying out euthanasia in reality. and reasons for legalization of the right of euthanasia, the main content of the second part is argumentation for legalize of citizens" rights of euthanasia, which including argumentation for right of euthanasia belonging to right of life and health, the feasibility for taking right of euthanasia out of right of life and health and be independent, and predicament of legalization of the right of euthanasia, the main content of the third part is methods for legalization of the right of euthanasia, its main contents including making legal conditions of exercising right of euthanasia definite, the legal procedures of exercising right of euthanasia, and the legal restrictions on exercising right of euthanasia.
