Nowadays, group rental has been more and more popular in the developed areaswith excessive-priced housing of China, such as Beijing, Shanghai, Guangzhou,Shenzhen, etc. Group rental means a special house lease that dividing one room intomulti-rooms. It is a phenomenon that is inevitable in the process of urbandevelopment, along with the rapid economic development,migrant workers continueto surge around,the house prices continue to heat up.“The first case of group rentalin Shanghai” in2006, the public’s attention first focused on the group rental on thiscomplex social problem, a series of legal disputes, such as neighboring relations,social security and health condominium ownership,and so on, have a serious impacton the harmonious development of society.After "the first case of group rental in Shanghai" happened, extensiveremediation activities about group rental have been expanded gradually which arebeing doubted by public. Since there is no direct law and regulation about grouprental, how to control this phenomenon becomes a difficult legal problem. The legalrelation among the property management company, the house-owner and the lesseehas been discussed in this paper through analyzing and sorting the rights andobligations between the subjects of the Shanghai group rental case. Then, the reasonwhy group rental appeared has been thought and analyzed in depth by the author.There exist the social background and reasonable elements of the group rentalphenomenon which offer the reality factor about controlling the group rentaleffectively. Finally, combined with the fundamental realities of our country, the authortables a definite proposal for the laws and regulations about group rental throughstudying the domestic and foreign numerous advanced laws and regulations.
