The Realization Of The Righet Of Letters And Visits Of Citizens In The View Of Supervisory Authority

The system of letters and visits is an incomplete system under the current system in China. Under the system, the letters and visits’ situation is not optimistic. Complainant cannot solve the problem on the one hand, resulting in frequent letters and calls of the extreme events; on the other hand, is the State organs for letters and visits try to evade those events, and their solution is a mere formality. Such the consequence is that the right of letters and visits of the citizens cannot be protected; many problems on the right are caused.Some aspects result in the situation, but three deep reasons are more important. First, the positioning of the legal nature of the right in China is not clear enough. The right should be a procedural right and a democratic right, and it is essentially a right of supervision. But in our country, the citizens and the state organs think that it is one of rights of relief. The group of letters and visits from vulnerable groups mostly lacks a mechanism to express their interest, which results in the poor communications between the people of letters and visits and the Government departments and the right of letters and visits of the citizens cannot be upheld. Finally, the bureaucratism seriously affects the solution of the problem from the letters and visits. How to answer these questions so as to achieve the objective of protecting the citizen’s right of letters and visits is the core of the research in this article.Author makes four recommendations for constructing the mechanism to realize the right of letters and visits. First, the prerequisite for realization of right is to strengthen the supervisory function of the right. Only the clear position of the right in the laws and regulations for the supervisory authority, can we untangle citizens’rights realization of the entire sequence of letters and visits, target for the entire work. Second, the key to realize right is to set up a strong social supervision system that contains the supervision of letters and visits. A country’s supervision system should not be isolated, only when they closely linked together, do they play the full surveillance role respectively. Due to the wrong positioning of the right in China, its supervise function is often free to other supervision systems. Only linking it with other supervision systems, can its supervise function be better reflected. Third, the bridge for realization of right is to construct the system of democracy earnest talk. The system is a valuable system, which not only provides an express platform fore system of letters and visits, but play a very important role in realizing the right reasonably and calming complaint. Fourth, the new road to realize the right is to build organs for letters and visits in the NPC. It not only suits the function of the NPC, but establish a sound body of system of letters and visits to achieve better results of solving complaints and to avoid bureaucratic obstruction to solving the issue of letters and visits, encourage the organs to actively maintain citizens’right of letters and visits.
