Since the last20th century, with the fast development rhythm of urbanization, there appears a large quantity of levying settlement dwellings in our country, which is caused by massive collective land levying and state-owned land’s house levying. Changsha’s typical case shows that there exist many legal issues.From the very beginning, the concept of levying settlement dwellings should be clearly defined. It is a little different from the common settlement dwelling. It is aroused by levying behavior, built by government investment or sometimes social investment, and only used for losing land or houses farmers and urban dwellers as a basic security house. Its primary nature would be quasi public goods. It has a variety of types, and the general type is classified basically on the land style, which is divided into collective land levying settlement dwelling and state-owned land levying ones. Currently, the collective land levying ones are the most controversial dwellings.Specifically, just because of the blur of ownership of settlement dwellings, ownership of settlement land and settlement transaction phenomenon, there appears many legal problems in practice. Research aspects including, house and land ownership and house transaction. The fact is that house ownership is uncompleted, collective land is forbidden and house transaction should be restricted. The resolve of house and land problem is mutually related, because using state-owned land could promote the independence of house ownership. And these two problems are the basement of disposing the transaction issues, only if the ownership is clear can citizens deal with each other safely and legally. What’s more? A proper regulation carried out by government is also necessary.
