Tourism has a "smokeless industry" and "eternal sunrise industry," the name for the expansion of employment and increase tax revenue are of great significance. China’s tourism industry developed rapidly in recent years, has made remarkable achievements. However, is incompatible with China in building the executive and legislative aspects of the tourism industry was relatively slow, which is extremely conducive to sustained and stable development of tourism. In view of this, I tried to China’s existing tourism industry for the study of the executive and legislative perspective to explain the foreign countries on tourism, tourism-related legislation, and to sum up the system, learn from their experience, maturity, made on this basis improve our tourism industry executive and legislative proposals, to be helpful for the executive and legislative. Into the twenty-first century, China’s tourism industry entered a stage of history. China has now become a world tourism power. However, the rapid development of tourism and the growing tourism market diversification, while diversification of the tourism industry of legal disputes, the number of complaints presented to tourism growth, the current state of China’s tourism industry needs to travel the Basic Law, enacted by the legislature----"Travel Act" to protect the legal rights of the main tourism and promote the rapid development of the tourism industry. This addition to the introduction and conclusions, is divided into four parts, the entire text style as follows:the first chapter focuses primarily on tourism in the executive and legislative issues facing our country today, then the executive and legislative law from tourism travel and tourism market, the main administrative organization of the relationship, the object of the executive and legislative tourism complex regulatory adjustments and the lack of small and lagging tourism executive and the legislature to conduct a comprehensive analysis of issues related to further elaborate on China’s tourism industry following the executive and legislative research was foreshadowing.Chapter to introduce legislation to focus on foreign travel, after World War II, the pace of development of tourism in the country is relatively rapid, especially after the twenty-first century, this time, as the global economy The rapid development of increasingly frequent economic exchanges, tourism, trade in services trade is growing, the gross national product in the country are accounted for on the high proportion of tourism in national economy has become a major economic industries, which either or in the form of development on the scale of development has been a fundamental change. New contradictions and new problems have appeared in front of all countries. In the tourism economy at a rapid pace of development in this environment, rapid development of tourism in the world in several countries have begun to have developed a number of tourism related tourism administrative regulations to deal with the process of development of tourism these problems and contradictions. For these relatively fast development of tourism in national and local good, they develop these tourism-related laws and regulations of China’s tourism development are good reference and experience of reference for the improvement of China’s major tourism development learning environment is essential. Japan, U.S., Singapore and Mexico have developed a comprehensive national tourism legislation as a template to conduct a comprehensive in-depth description and assessment of them, summed up their useful elements of tourism legislation, so as to arrive on China’s tourism industry executive and legislative an important revelation. The third chapter describes the current situation of China’s tourism industry executive and the legislature, in-depth analysis of its causes. For a country or a region of tourism development, tourism executive and legislative activities in the tourism plays an important role in the process, he not only adjust the tourism activities in the process of legal relationship, which aims to protect the tourism industry healthy development. Its problems to some extent hindered the development of tourism, will be summarized in three points were to be refined and elaborated. First, inadequate laws and regulations, there is no unified tourism Basic Law, followed by fair and free competition in the tourism industry needs to regulate the law once again is the lack of uniformity and transparency of the existing regulations, and with the law of the World Trade Organization. Which also contains the last point in four small areas, namely: First, the travel and administrative regulations in most of the principles of the World Trade Organization does not match; second, the lack of a Basic Law to unify the tourism industry of tourism administrative regulations; Third, regional protectionism under the executive and legislative difficulties; Fourth, the development of tourism too fast, the executive and legislative content suited to the development of tourism. This part is to analyze China’s tourism industry in the executive and legislative issues.Chapter IV, by the preceding analysis shows, the problem is scaled to the executive and legislative measures in the tourism industry, not only take care of the foregoing discussion, but also for tourism in the executive and legislative below provides a major improvement of writing context. In this vein, the author’s previous paper describes the experience as the bottom plate of foreign legislation to China’s basic national conditions and practice to master legislation, to ensure the healthy development of China’s tourism industry, proposed a system solution. The establishment of the Basic Law, China’s tourism in this part of the Basic Law, the author describes the development of specific methods of travel, but also explained the need for the development of tourism and the development of the Basic Law, the Basic Law, the feasibility of tourism, tourism should have the basic content of the Basic Law, in theory, should include two Most of the content, should be provided as part of how to resolve disputes, tourism legal norms, mainly referring to tourists and travel agencies, the legal relationship between, multi-fingered travel contract. Second part of the tourism enterprises engaged in tourism activities, licensing standards, this part of the tourism administration department of the general guidelines for the management of tourism enterprises, and more with the characteristics of public or administrative law. Tourism in all regions of the adjustment of the Basic Law, the relationship is basically the same, so basically travel the Basic Law, no differences in the content, including:(1) determine the objectives and principles of tourism development,(2) provides tourism resources development and protection principles,(3) provides that the administrative body of the tourism authority,(4) determine the conduct of tourism enterprises,(5) to determine the travel consumer’s legal rights and obligations,(6) identification and development of international cooperation in tourism is also the content,(7) violation of the Basic Law should assume travel a total of seven parts of legal responsibility. In addition to the establishment of the Basic Law, there are other tourism improvement of tourism in the executive and legislative measures, such as the development of tourism-related laws to protect fair competition in the tourism industry, in the "Anti-Unfair Competition Law" to add provisions on business and tourism in the "Contract Law "chapter of the contract to increase tourism, improve the tourism industry which are the executive and legislative measures. At present, China’s tourism industry executive and the legislature, there are still many problems, we want a comprehensive analysis and improvement of China’s tourism industry executive and the legislature, on the characteristics of China’s tourism industry to accelerate the establishment of the Basic Law put forward corresponding countermeasures.
