Research On The Legislative Hearing System Of China

The legislative hearing system originated in western countries. As a system toimprove the legislation more scientific and democratic, it has been formallyestablished by China’s Legislation Law article34and article58. This Introduction ofthis article introduces the research background, the status of legislative hearing athome and abroad, research ideas and methods. The second chapter introduces thedefinition of the concept, the basic functions of legislative hearing. The third chapter,points out the background reasons in three aspects of legislative hearing in China,the socialist market economy, the democratic politics and the awareness of the law,for the establishment of legislative hearing. The fourth chapter analysis’s the existingproblems in both rules and practical operation of China’s legislative hearing system.It takes the rules and practices of the legislative hearing as the object of study, by themethods of literature research and systems analysis. The fifth chapter introduces theexperience of the foreign countries, and makes the suggestion on china’s legislativehearing system in order to improve the effect of china’s legislative hearing system.
