Research On The Supervisory Model Of Public Trust In Perspective Of Public Governance

Public Trust is an effective platform to raise the capital for the public institutions, aneffective management of public service property, also a good system to promote the socialfairness and justice, and a continuous thrust to boost the national development, so thepublic trust are highly valued in many countries. After the founding of new China, thesocial welfare undertakings long in the framework of the planned economic system, itsfunding came mainly from the government budget with little involvement of civil forces,which obviously showed the characteristics of government-run. After reform and openingup, the wave of market economy pushed public welfare to the society. However, due to along period of the planned economy system, China’s public welfare could not adapt to thedevelopment of the situation. The most prominent problem fell into two aspects: first,public interest organizations often had corruption, misappropriation of charity money,operation lack of transparency and violation in running charity; Second, a lot of moneymastered by public interest organizations could not effectively appreciate. Therefore, it isno doubt a feasible way to learn the advanced experience of developed countries in thedevelopment of public welfare and realize freedom, security and high efficiency of thepublic welfare funds use by the way of public trust.Public trust legislation in China began in the formulation of the Trust Law in2001.China’s Trust Law" dedicates one chapter to public trust to provide the specific guidance,but owing to imperfection of the supporting systems, in particular the regulatory system,the charitable trust business in China has not been developed effectively. Therefore, it is ofgreat practical significance to improve the regulatory system of our public trust, to explorethe Chinese-characteristics regulatory model in public trust. Precisely because of this, thethesis selects“study of the regulatory model of public trust in public governanceperspective” as a research topic. The purpose of the study lies in proposing a new model ofimproving the supervision of China’s public trust-public trust “pluralism co-governancemode” in order to promote the sound development of the public trust business throughin-depth analysis of the plight of our public trust regulation and the causes of the problem.From the perspective of the overall governance I try to build a multi-center governanceorder and governance structure of public trust in the system, functional andenvironmental dimensions, to design multi-center governance system of public trust, and to construct public trust "pluralism co-governance mode " adapting to the currentpolitical,economic and cultural development needs.The text, illustrated in the thinking way of "problem-reason-response is dividedinto five parts. The first section describing the origin and significance of this study, sumsup the dynamic study of this topic at home and abroad, and makes a clear idea of thethinking way and the approach of the study. The second explains the theory related withthe topic, including the basic theory of public trust, the public governance theory, thetheory of "single-center governance" and " polycentric governance" theory. The third partcombing the development and regulatory overview of public trust, discusses thedevelopment stages the public trust business as well as regulatory policy in the variousstages. Part IV makes in-depth analysis of regulatory difficulties of public trust and theunderlying causes lack of supervision. Through the integration of the literature, the authorfinds that the fundamental reasons of the lack of supervision for the public trust lie insingle-center governance mode of the regulation of public trust ". In this mode the publictrust shows a unified pattern of governance body, a single center of governance power, apyramid structure of governance structure, and a controlling trait in the way of governance.When government officials are coupled with the trustees of public trust, the operation ofthe model cannot work, which is the underlying causes the lack of supervision of the publictrust. The fifth part based on the comprehensive analysis of the drawbacks of the model of"single-center governance of the public trust, the realistic demands of the public trust andthe advantage of “pluralism co-governance mode”of the public trust, tries to build theregulatory innovation of China’s public trust mode-the public trust “pluralismco-governance mode”.
