The law of strategic policy notonly requests the judicial authority to enforce the law, safeguard judicial justice, butalso requires a perfect legal system to protect. The clerk as an essential element in thework of judges judicial support staff, assisting the judges hearing, the handling of thecase, organization of production of instruments and served sentences and a series ofactivities, is important member of the court system, their reform is also a concern.Establishment and improve the clerk management system, build a high-skill,high-quality judicial team is responsive to the reform and development of judicialrequirement. This article primarily through the analysis of the October2003issuedjointly by the Organization Department and the Ministry of personnel and the SupremePeople’s Court of the people’s court clerk management procedures (trialimplementation)(hereinafter referred to as the regulations) a series of problems thatarise in their implementation, combined with some overseas than in more developedcountries such as the United States and the United Kingdom and Japan’s judicialsystem, puts forward the suitable conception for China’s reform. The main conceptfrom six different aspects of the system construction to improve China’s existing clerksystem includes a clear division of responsibilities for the clerk, specification clerkselection mechanisms, enhance the clerk business training, improve the appraisalmodel of clerk, clerk sequence promotion management system, and establish the clerkaccountability mechanism. This paper uses comparative analysis and summary of theresearch methods, the clerk sequence alone around the establishment of themanagement mode, and puts forward some supporting staff selection, trainingmechanism and promotion mode. Clerk of realization of separate sequences, allowedclerks to receive in their sequence of posts and the level of promotion, improve clerkswork abilities and work enthusiasm, and change the bottleneck of the existing clerksystem.
