The protection of personal privacy has always been a topic of widespread concern. Nowadays,with the rapid development of genetic technology, genetic technology brings the interests of humanity,while individual’s genetic information has been severely abused and violated. Disclosure of genetic information has been threatening the stability of the personal life at any time, which comes into being a new demand for the right to privacy-the right to know of generight. Since there is no legislation of the right to know of gene in our country,it is quite necessary to build a reasonable balance mechanism between the utilization and circulation of genetic information and the right to know of geneto protection the right to know of genein law. To this end, the paper is divided into three parts.Part1,preface. According to describing the story, I lead to the reason that I write this paper.Part2,mian body,it is divided into four chapter. Chapter one is an overview of the genetic information and genetic privacy.the chapter starts from definition of the concept and legal nature of genetic information,we conclude that genetic information has the attributes of personality rights,and then introduce the creation and concept of genetic privacy.the last part of the chaper discusses the forms of protection of genetic information between in property and privacy.Chapter two Introduce the situation of the domestic and international legislation on the protection of genetic privacy,to compare our country’s the right to know of gene legislation with foreign by the horizontal view.Chapter three discusses several key issues and difficulties in the protection of the genetic privacy. Such as the main body of genetic privacy,the conflict between the right to know one’s gene and genetic privacy,"informed consent" on the insufficient of protection of genetic privacy.This chapter lays a theoretical foundation to build a reasonable mechanism.Chapter four regulates the legislation of our country’s the right to know of gene on the macro level,meanwhile, trying to do some specific system build between the right to prvicacy of geneand gene flow of information on the micro level.Part3, The concluding section is the summary of the full text.
