This paper is based on the stipulations of treatment program fromMental Health Law (Draft), which is announced in June,2011. It analyzes thereasons that those who should not be treated receive forced treatment, whichis from the following parts, such as the main part of treatment, the standardsof treatment and the right relief. According to the comparison and analysis oflaws, rules and regulations of forced psychiatric treatment proceduresbetween domestic and abroad, it discusses the means which can make theshouldn’t have been received and cured ones not to be treated as psychopathand make the compulsory receive and cure ones receive welfare under theprocess of supervision and administration based on the present system.This essay suggests that if enough funds is invested by a nation, the oneswho send patients, their related information can be registered in detail andreported integratedly in order to make a preparation for the relief in the futureand the third party consisting o f the part-time staff can be regarded as the check organization to recheck the compulsory receiving and curing cases andto make further improvement on being sure of the received and cured ones’right of petition and their right of visiting lawyers.Moreover，supervision canbe consummated by the third party above mentioned and Civil AffairsBureau.
