Discussing The Perfection Of Secret Investigation System In Chine

As a new means of investigation, the secret investigation has advantage that thetraditional investigative manner does not have, but also has shortcomings that thetraditional investigation manner does not have, So it is necessary to improve the system ofsecret investigation. Perfect secret investigation system is the need of judicial practice andimproving investigation benefit first, second the perfect secret investigation system is theneed to maintain the credibility of justice and protect the basic human rights of citizens.From the current situation of the legislative and judicial practice of China’s secretinvestigation system, secret investigation system there are still inadequate legislation, lackof effective supervision, lack of relief channel and unsound relevant evidence system, toimprove the secret investigation system in China, we must be on the basis of learning theadvanced experience from foreign countries to perfect legislation, create a secretinvestigation system of supervision and control mechanism, establish relief ways of secretinvestigation and clear evidence relevant to the use of secret investigation system.This paper’s study starts from the basic theory of the secret investigation, firstintroduces the connotation of the secret investigation, including the concepts and types ofsecret investigation, then introduces the five characteristics of the secret investigation andanalysis the need to improve the system of secret investigation; subsequent articledescribes the status quo of China’s secret investigation and pointes out the problem thatthe secret investigation system at this stage has;into the inspection part of the foreignsecret investigation system, introduces the system of secret investigation of the fourcountries of the United States, Britain, Japan, Germany; finally, proposes the suggestionsfor improvement of the system of China’s secret investigation, including improving thelegislation of the secret investigation, establishing a mechanism of supervision of thesecret investigation, establishing the illegal secret investigation relief ways and clearingevidence of the use of system-related secret investigation.
