Following the trend of human civilization evolution, human right has become universal concept in human society. The relevant laws of the UN and various countries emphasize on the protection of human right in criminal investigation. Especially International Human Right Law stipulates the prosecuted party has human rights related litigation in criminal procedure. Recently, our country pays more and more attention to the problem of human right. In China, Local government signed International Convenant on Economic, Social and Cultural Rights and International Convenant on Civil and Political Rights.In 2004, Amendments to the Constitution of the People's Republic of China further stipulates: the country should respect and protect human rights and take it as one important principle of constitutional law. This action is the breakthrough in socialization and will improve the development of human rights in China.As one prop for human rights, I found out that there was a weak awareness of human right protection and inefficient law system leading to the problems of human right protection in duty crime detection. Pursuant to the spirit of nomology, this essay is to discuss the current situation of human right protection and improvement methods in duty crime detection through analysis of current hot question in the field of human rights, which pave the way for future work of human right protection in crime investigation.
