Protection of the rights of persons with disabilities in the civil airtransportation has got more and more attention in the internationalcommunity. The disabled can enjoy the opportunity to air travel as well asother citizens. They should enjoy equal and even more favorabletreatment. But in China, since protection of rights of persons withdisabilities in the air transportation is on the late start, there are still someproblems and lags we have to face in the full protection of the rights ofthe disabled passengers in air transportation. Provisions of regulation oncivil aviation transportation about the travel rights of the disabled cannotmeet the practical needs. And there is a lack of legal system and effectiveimplementation and supportive standards system for the protection of therights of the disabled in air transportation. Comparing to InternationalAviation Organizations and the international community, matureregulations and practices in the facilitating the procedures for the disabled travelers, comprehensive and non-discriminatory treatment of thedisabled, and the compulsory executive procedure on the protection of therights and interests of the disabled are worth learning. In the way ofimproving the interests of disabled travelers in the air transportation, weneed to perfect the related regulations on the Air Transportation withPersons with Disabilities. Part of the terms of Regulation on AirTransportation with the Disabled (Trial) should be made up and adoptedaccordingly. At the same time its level of effectiveness should also beenhanced. In addition, Civil Aviation Authorities and social forces shouldmake concerted efforts to achieve and guarantee basic human rights forthe disabled.
