International Financial Institutions, represented by the World Bank, to some extent play important and active roles in China’s economic development and social progress, the loans of which are the main sources of foreign investments and also facilitate China’s connections with the world. When borrowing a comparatively large amount of loans, except for the external communications and negotiations as necessary, the constructions of domestic policies and procedures are equally important. This paper focuses on domestically onlending loans borrowed by China from International Financial Institutions. On a basis of introducing the current procedures of onlending and conducting researches on the laws and regulations related thereto, legal analysis will be carried out in connection with the issues existing therein and certain advices will be rendered with respect to system construction and amendments to the laws and regulations. In addition, this paper also keeps an eye on the settlements of disputes arising from onlending loans of International Financial Institutions. By going through the cases already occurred, certain issues are summarized which should be paid attention to by government agencies, onlending banks and project entities for purpose to avoid disputes and protect their rights and interests and some advices are also rendered in connection with hearing of similar cases for judicial authorities’reference.This paper consists of five parts, among which, the first chapter mainly discusses matters relating to loans of International Financial Institutions, including the general descriptions of International Financial Institutions, the analysis of features of loans of International Financial Institutions and the research on basic legal documents involved in loans of International Financial Institutions; the second chapter, based on recalling the history of China’s borrowing loans of International Financial Institutions, summarizes the domestic and external procedures thereof; the third chapter, as the core of this paper, put emphasis on a range of issues in relation to onlending loans borrowed by China from International Financial Institutions, which include clarifying certain concepts, summing up practical experiences and discussing the legal issues related thereto; the fourth chapter brings in case study, in which part the author will conduct a detailed analysis on two typical cases, one of which was published by the Supreme Court, and give some advices correspondingly; the last part is the conclusion of this paper.
